Probate in Walton County: Where It’s Filed

Santa Rosa Beach is in Walton County, which sits in Florida’s 1st Judicial Circuit. Probate is filed with the Walton County Clerk of Courts and Comptroller, in the county where the decedent was domiciled at death. Cases are handled at the Walton County Courthouse at 571 U.S. Highway 90 East in DeFuniak Springs, where the Clerk’s Probate Division sits, with a second Clerk’s counter at the South Walton Courthouse Annex, 31 Coastal Centre Boulevard in Santa Rosa Beach. Local Rules, Judges, and the Clerk’s Probate Office

Every circuit publishes administrative orders and local procedures that control how probate actually runs in Walton County, including which division gets the case, which checklists are required, and how proposed orders reach the judge. Walton consolidated a split probate docket on January 1, 2026, so all probate and guardianship now sits with one circuit judge who is also the county administrative judge. A remote appearance is the exception here rather than the rule, because a hearing of one hour or less may be held on Zoom if every party agrees, and otherwise it takes a written motion with a proposed order at least five days before the hearing date. Proposed orders go through the portal in Word with a cover letter within five business days of the proceeding. The Clerk keeps the Probate Division at the courthouse in DeFuniak Springs and a second counter at the South Walton Courthouse Annex in Santa Rosa Beach, and there is no fee to file a will after a death. Walton is the exception to the pattern in this circuit. The county’s published directive library holds fourteen documents and not one of them is about probate practice, so a Walton estate runs on the Florida Probate Rules plus the assigned judge’s own written procedures, with the division assignment directive the only order that touches probate at all.
